1. About these terms
1.1 These Terms of Use apply to malemasseurs.com.au (the Site), operated by Male Masseurs, a business name of Gustavo Isidoro Domingos Francisco (ABN 13 227 493 119) (we, us, our).
1.2 By using the Site you agree to these terms. If you create a therapist account you also agree to our Profile Rules and Privacy Policy, which form part of these terms.
1.3 We may update these terms. We will post the new version on the Site and, for material changes, email therapists at least 14 days before they take effect. Continuing to use the Site after that date means you accept the change.
2. What the Site is
2.1 The Site is an advertising directory. It lets independent massage therapists (Therapists) publish a profile and lets members of the public (Clients) find and contact them.
2.2 We do not provide massage services, employ Therapists, take bookings or handle payments between Clients and Therapists. Any arrangement is solely between the Client and the Therapist.
2.3 The Site is for professional, non-sexual massage only. Advertising or requesting sexual services is prohibited and will lead to removal.
2.4 You must be 18 or older to use the Site.
3. Clients
3.1 Clients can browse the Site without an account. Information in profiles is supplied by Therapists. We review profiles before publication but do not guarantee that information about qualifications, rates, availability or location is accurate or current.
3.2 Before booking, confirm details such as qualifications, price and location directly with the Therapist, and tell them about any health conditions that may affect treatment.
3.3 Testimonials must be honest, based on a real experience and free of offensive or identifying content. We may moderate, shorten or decline any testimonial.
3.4 If a profile breaks these terms, use the “Report this profile” link on that profile or email contact@malemasseurs.com.au.
4. Therapist accounts
4.1 To list a profile you must:
- be at least 18 years old;
- have the legal right to work in Australia;
- hold any qualifications, insurance, registrations or local permits that apply to the services you offer;
- provide true and complete information, including your legal name, date of birth and a valid government photo ID.
4.2 We may ask you to verify your identity again at any time, including by uploading a photo of yourself holding your ID and a one-time code. We may refuse, pause or remove a profile until verification is complete.
4.3 Every profile is reviewed before going live. We may refuse any application at our discretion.
4.4 You are responsible for your account and for keeping your password secure. Tell us immediately if you suspect unauthorised use.
4.5 You are responsible for your own services, conduct, tax obligations and compliance with all laws, including health, consumer and local council requirements. You are an independent business, not our employee, contractor or agent.
5. Profile content
5.1 You keep ownership of the photos and text you upload. You give us a non-exclusive, royalty-free licence to host, display, resize and promote that content on the Site and in our marketing while your profile is listed.
5.2 You must only upload photos of yourself that you own or have permission to use. Photos must follow the Profile Rules: no shirtless, nude, partly nude, underwear or sexual photos, and no images of other people without their consent. New photos are checked before they are published.
5.3 We may edit, hide or remove content that breaches these terms or the Profile Rules. We may use automated tools to help review content.
6. Plans, credit and fees
6.1 Listing a profile is paid from prepaid credit (Credit) held in your account. The current plans, daily prices and add-ons are shown on the Site and in your account. Prices are in Australian dollars. GST is not charged as we are not registered for GST.
6.2 The daily fee for your plan and any active add-ons is deducted from your Credit once per day while your profile is approved. If your Credit is not enough for the next day’s fee, your profile is automatically hidden until you top up. We send reminder emails before this happens, but you are responsible for keeping enough Credit.
6.3 You may top up Credit by bank transfer, PayID or BPAY in the amounts offered on the Site. Credit is added once we confirm the payment has been received, and a receipt is emailed for each confirmed top-up.
6.4 New Therapist accounts may receive a one-off promotional Credit (currently $30) when approved. Promotional Credit has no cash value and cannot be transferred or refunded.
6.5 Plan changes and add-ons may need our approval and apply from the next daily charge.
6.6 Credit is not a deposit and does not earn interest. Unused paid Credit is not refundable except where required by law, or where we close your account without cause, in which case we refund unused paid Credit.
6.7 We may change plans and prices. We will give at least 14 days’ notice by email before a price increase applies to you.
7. Prohibited conduct
You must not:
- advertise, offer or request sexual services;
- post false, misleading or deceptive information, including fake testimonials;
- impersonate another person or use someone else’s photos;
- harass, threaten or discriminate against anyone;
- collect other users’ details for spam or unrelated marketing;
- copy, scrape or republish the Site’s content or data;
- try to interfere with, hack or overload the Site or get around its security features;
- use the Site for any unlawful purpose.
8. Suspension and termination
8.1 You may close your therapist account at any time by contacting us.
8.2 We may pause, hide or close any account if we reasonably believe you have breached these terms or the Profile Rules, given false information, or put Clients or the Site at risk. Credit may be forfeited where an account is closed for a serious breach, to the extent permitted by law.
9. Liability
9.1 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
9.2 Subject to clause 9.1, we are not responsible for the services, conduct, qualifications or safety of any Therapist or Client, or for any arrangement between them.
9.3 Subject to clause 9.1, the Site is provided “as is”. We do not guarantee that it will be uninterrupted or error-free, or that a profile will generate any number of enquiries.
9.4 To the extent permitted by law, our total liability to a Therapist in connection with the Site is limited to supplying the listing service again or refunding the fees paid in the 3 months before the claim.
9.5 You agree to indemnify us against claims arising from your content, your services or your breach of these terms, except to the extent caused by our own negligence.
10. Intellectual property
The Male Masseurs name, logo, design and Site content (other than content supplied by users) belong to us. You may not use them without our written permission.
11. Third-party links and services
The Site may link to or rely on third-party services. We are not responsible for their content or practices.
12. General
12.1 These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
12.2 If any part of these terms is invalid, the rest continues to apply.
